Key Takeaways & How You Can Help:
- On Tuesday, February 18, the South Dakota House Health and Human Services Committee will vote on House Bill 1101 (HB 1101), which would completely eliminate the state’s medical marijuana program.
- HB 1101 is a direct attack on South Dakota voters and patients. Nearly 70% of voters approved medical cannabis in 2020, and this bill would strip away that access entirely.
- Patients will lose access to vital care. Those suffering from chronic pain, epilepsy, cancer, PTSD, and other conditions will be left without legal medical cannabis options.
- We must act now. Contact information for each member of the Health Committee can be found below (phone and email). Vote NO on HB 1101 and protect patient rights.
In 2020, South Dakotans made history. In one of the highest voter turnouts in state history, nearly 70% of voters approved Initiated Measure 26, legalizing medical marijuana. This was a clear, decisive mandate to prioritize patients’ rights and access to care.
Now, lawmakers are attempting to betray that mandate. HB 1101 is a blatant attack on the will of the people. This bill seeks to eliminate South Dakota’s entire medical marijuana program, stripping away the access that voters overwhelmingly supported. Not only does it threaten patients who rely on this program, but it also disregards the nearly 300,000 South Dakotans who demanded this change in one of the most decisive electoral victories in our state’s history.
Just three weeks ago, we warned you about HB 1055, a bill attempting to make medical marijuana access even harder by requiring two separate doctor approvals. Thanks to your efforts, we fought back against that attack. Now, HB 1101 is going before the same House Health and Human Services Committee— next week Wednesday February 18th, it seeks to completely eliminate South Dakota’s medical marijuana program.
At My Marijuana Cards, we exist because of the will of South Dakotans who voted for this program back in 2020. Without that vote, we wouldn’t be here to help patients get the care they need. We know it may seem like we’re reaching out to you a lot about these bills, but we have to—because every year, access to medical marijuana is under attack. We feel it’s our responsibility to keep you informed and to fight alongside you to protect the rights you voted for.
What’s at Stake with HB 1101?
- A Direct Betrayal of Democracy: The people spoke loud and clear in 2020. HB 1101 is a slap in the face to the voters who stood up for medical cannabis and patient rights.
- Patients with state-approved qualifying conditions will lose access to vital care. This bill would leave countless patients suffering from chronic pain, epilepsy, cancer, PTSD, and other conditions without the relief they desperately need.
- A Dangerous Precedent: If legislators ignore a clear vote of the people on this issue, what’s stopping them from undermining democracy on others?
