Requirements for Medical Marijuana Cards in South Carolina

Age & Residency Requirements

You must fulfill the following requirements to be eligible for medicinal marijuana therapy in South Carolina:

-You must be diagnosed with one of the qualifying ailments for medicinal marijuana therapy.

The current version of the Compassionate Care Act is unlikely to pass into law. However, if SC ever has a medical marijuana program, the application process will probably look similar to other MMJ programs. It seems as if the South Carolina Department of Health and Environmental Control would oversee the program. The bill would also lead to the creation of a Medical Cannabis Advisory Board.

download An MMJ program in South Carolina will be virtually universal. In South Carolina, you must be 18 years old. Make an appointment with a state-licensed doctor. They will inquire about your health. The current law says the doctor must verify that you have a qualifying medical condition. They must also determine that conventional therapy and treatments have failed to help.

Prospective MMJ patients would likely be able to apply online after receiving a doctor’s written certification. After completing the form, applicants would need to wait for the department to decide if they are eligible.

As per the Compassionate Care Act, the SC medical marijuana card qualifying conditions would include:

SB 366 further specifies that a person is qualified if they have a severe or chronic illness or medical condition for which an opioid is being used or may be given by a doctor “based on widely recognized standards of care.”

The South Carolina MMJ card would be valid for one year.

While it may be possible to complete your application online, all doctor’s appointments would have to be conducted in person.

The present Compassionate Care Act version is unlikely to become law. If South Carolina ever establishes a medicinal marijuana program, the application procedure will most likely be comparable to those of other MMJ programs. The initiative seems to be overseen by the South Carolina Department of Health and Environmental Control. The measure would also establish a Medicinal Cannabis Advisory Council.

There is no definitive information on medical marijuana card costs in SC or the price of a doctor’s consultation. However, few MMJ programs in other states have an application fee of over $100, with most charging $50 or less. The bill does mention that the department will provide discounts for application and renewal fees based on the applicant’s household income.

Applicants must be certified by a doctor who has a valid South Carolina medical license and is registered with the state.

The Compassionate Care Act states that the department “shall waive all applicable fees for veterans.” Therefore, military veterans in South Carolina could apply for free, although they would still need to pay a physician consultation fee.

Caregivers help medicinal marijuana patients (including minors) who cannot or do not want to go to a dispensary to buy their medicine. Patients may designate caregivers who must be 21 or older and registered with the state. A caregiver may buy medicinal marijuana for a patient and assist in administering it.

The bill states that MMJ patients would be allowed to use a designated caregiver. A caregiver must be 21+ unless they are the parent/guardian of each qualifying patient they assist. Although there are exceptions, caregivers in South Carolina could only serve one patient as per SB 366.

The Compassionate Care Act states that MMJ patients can have caregivers. However, such individuals must be 21+ unless they are the parent/legal guardian of the qualifying patient. MMJ patients may name a maximum of two caregivers. Once approved, caregivers will receive a registry ID card.

No, insurance companies do not pay medicinal marijuana expenditures due to federal legal problems. Legal patients may get medicinal marijuana from any state-licensed dispensary. They may also use their card in states that reciprocate.

According to SB 366, MMJ patients in South Carolina would be permitted up to two ounces of cannabis in a 14-day period.

The bill isn’t clear regarding the options available to MMJ patients, although it appears that marijuana flower would be permitted. SB 366 also mentions a maximum of 10mg of THC in edibles. Yet, even though the act may allow flower, it also states that smoking marijuana is illegal, with a fine of $150 for anyone who is caught breaking this law.

It is unlikely that any MMJ bill which passes into law will contain a provision for growing marijuana.

No, HIPAA protects you as a medical patient. My Marijuana Cards values our patients’ privacy and security. Nobody will know unless you tell them or until you take a drug test for marijuana. Medicinal marijuana patients are protected. Patients do not have to reveal their medicinal marijuana status or submit to a search. If a search turns up medicinal marijuana, the patient should provide their ID card or refer the officer to the state database to prove they are an authorized patient.

It is unclear, although SB 366 does mention nonresident cardholders diagnosed with a debilitating medical condition.

State reciprocity for North Carolina medicinal marijuana patients is presently available. Yes! You need not visit the same doctor every year. My Marijuana Cards would gladly certify you if you were certified by another medical marijuana doctor last year.

At this stage, patients would need to reapply by receiving certification from a licensed physician again. The DHHS must approve or deny a renewal within 45 days of receiving the application.

It is unlikely that any MMJ bill which passes into law will contain a provision for growing marijuana.

Nevertheless, few MMJ programs in other states charge more than $100 for an application, with the majority costing $50 or less. Your doctor will register you with the Commission after they have verified your medicinal marijuana requirement. The Commission will develop the form and determine the cost, which will be limited at $65. The legislation allows enable the Commission to establish new requirements.

Minors may apply for compassionate care under the Compassionate Care Act. When a minor (someone under the age of 17) applies, a doctor must submit written certification to a chosen parent or legal guardian with the legal ability to make healthcare decisions on behalf of the minor. 

Applicants between the ages of 18 and 23 must provide written certificates from two physicians.

To apply for a medical marijuana card in SC, as per the Compassionate Care Act, you would need to be a state resident aged 18+ with a qualifying medical condition. However, the bill makes provisions for minors and out-of-state MMJ patients.
