href=\"https:\/\/www.mykxlg.com\/news\/local\/s-d-rules-committee-passes-marijuana-proposed-rules\/article_e5b3a8fe-1548-11ec-a960-2f70d9af9c5b.html#:~:text=The%C2%A0Legislature%E2%80%99s%C2%A0Interim%20Rules%20Review%20Committee%20approved%20the%20Department%20of,%C2%A0The%20legislature%20approved%20143%20of%20149%20proposed%20rules.\">South Dakota Legislatures Rules Review Committee approved 143 of the proposed rules<\/a> but rejected six of them. They were then sent back to the Department of Health for evaluation and now five of them have been updated with new guidelines.<\/p>\n<p>Old Rule: Initiated Measure 26 initially stated that patients certified to grow their own cannabis at home could have only three plants, unless a physician recommends more.<\/p>\n<p>New Rule: The newest rules now state if a physician recommends a patient to grow more than three plants, it expires 200 days after the date of the recommendation. It is also required that the physician must specifically state the reasons for the extended plant count.<\/p>\n<p>New Rule: Under the new changes, no medical marijuana cardholder under the age of 21 will be allowed to purchase any form of cannabis flower, including products such as pre-rolls, and possession of any inhalable cannabis products is prohibited.<\/p>\n<p>Other rule changes that were made include requiring product packaging to indicate that an item contains cannabis or cannabis extract that will be used by all registered establishments. Advertising cannabis in any form will also be prohibited unless and until the U.S. DEA removes cannabis as a Schedule I controlled substance.<\/p>\n<p>All of the proposal revisions can be viewed on of medical cannabis for their qualifying condition. If yes, a medical certification is issued through the on-line portal for the patient. Physicians must create an account at medcannabisapplication.sd.gov to provide written certifications.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Step_Three\"><\/span>Step Three:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Patient receives email to create account on medcannabisapplication.sd.gov. The cardholder may then purchase cannabis from a certified dispensary.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"When_Will_South_Dakota_Begin_Issuing_Medical_Marijuana_Cards_To_Patients\"><\/span>When Will South Dakota Begin Issuing Medical Marijuana Cards To Patients?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The South Dakota Department of Health must begin issuing medical marijuana cards to registered patients by <b>November 18. <\/b><a href=\"https:\/\/ballotpedia.org\/South_Dakota_Initiated_Measure_26,_Medical_Marijuana_Initiative_(2020)\">Initiated Measure 26<\/a> initially required the regulatory framework of the medical marijuana program to be generated within 120 days of its taking effect, or by October 29, and the first medical marijuana cards to patients need to be issued within 140 days, or by November 18. The following may include:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">A valid ID, state ID, or South Dakota Driver\u2019s License<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Medical records documenting the diagnosis of your qualifying condition(s) <b>may<\/b> also be required during the time of your appointment for the doctor to review.<\/li>\n<\/ul>\n<p>Once approved by the physician, you will need to submit an application along with your written recommendation from the doctor to the <a href=\"https:\/\/aca-prod.accela.com\/SDDOH\/Welcome.aspx?TabName=Home&amp;TabList=Home%7C0%7CCannabis%7C1%7CCurrentTabIndex%7C0\">South Dakota Medical Cannabis Program (SDMCP)<\/a>. A non-refundable application fee of $75 ($20 for qualifying low-income patients) must also be submitted at this time in order to have your application reviewed.
